Can a Friend Officate a Wedding

I get asked this question alot - Can a friend or family member officiate our wedding ceremony?

Short answer, no - not unless they're a registered marriage celebrant. In Australia, only an authorised celebrant can legally officiate a wedding — so unless your friend has gone through that formal training and registration process themselves, they can't be the one who makes it legal.

BUT! There is a BUT!

That's usually not the end of the idea, though. It just means the legal side and the "leading the ceremony" side need to be split between two people.

What does "officiate" actually mean, legally?

Officiating a wedding specifically means overseeing the legal requirements of the marriage — checking the paperwork, witnessing the vows, and making sure everything's lodged correctly afterwards. That's the part the law reserves for a registered celebrant. Standing up the front, telling your story, and guiding the moment isn't the same thing, and it doesn't require any authorisation at all.

So how do couples still have a friend lead the ceremony?

The legal marriage happens privately with a registered celebrant, typically in the days before the wedding — the paperwork, the Notice of Intended Marriage, and the formal vows required under the Marriage Act. Once that's done, the ceremony day itself is free and clear. There's no legal wording left to say and nothing to sign in front of your guests, so your friend is simply there to lead the celebration you've actually planned.

What does the celebrant handle, and what does the friend handle?

The celebrant's part

The Notice of Intended Marriage, checking identification documents, the formal vows, and lodging the marriage with Births, Deaths and Marriages afterwards. All handled quietly, ahead of time.

Your friend's part

Everything you actually see on the day: the welcome, your story, personal vows, rings, and sending you off. None of it is legally binding, which means none of it has to follow a set script.

What does your friend need to know before saying yes?

They don't need to be a natural public speaker, and it doesn't need to be word-perfect. They'll want to have a chat with you about tone beforehand, write it in their own words, and read it aloud a few times so it sounds like them — not a formal speech. A short pause to breathe on the day never once ruined a wedding.

How To Write Your Own Wedding Vows | Australian Guide

Writing your vows is the job most couples put off longest. It sits at the bottom of the list behind the seating chart and the shoes, and then it surfaces at eleven o’clock at night about three weeks out, usually accompanied by a small quiet panic.

So let me take some pressure off before we start. Your vows don’t need to be beautiful. They need to be true. I’ve stood beside couples through vows that were three sentences long and watched a hundred people cry, and I’ve listened to elaborate, carefully crafted vows that landed on nobody because they didn’t sound like the person saying them.

Here’s everything you need — including the part most vow guides skip, because most of them are written for American couples.

Can you write your own wedding vows in Australia?

Yes. You can write and say whatever you like — but you must also say a specific set of words required by law. Your personal vows sit alongside the legal ones, not instead of them.

This trips up a lot of couples, because most of the vow-writing advice online is American, and the United States has no equivalent legal requirement. In Australia, there are words you have to say.

What words are legally required in Australian wedding vows?

Under section 45(2) of the Marriage Act 1961, each of you must say to the other, in front of your celebrant and two witnesses, words to this effect:

I call upon the persons here present to witness that I, [your full name], take thee, [their full name], to be my lawful wedded wife / husband / spouse.

You choose the term. Wife, husband or spouse — the word you use isn’t determined by anyone’s gender. Pick whichever fits.

‘Or words to that effect’ allows some flexibility. The phrasing can shift a little. What can’t change is the substance: you must call on those present to witness, and you must clearly state that you are taking this specific person as your spouse.

It can’t become a question and answer. Your celebrant isn’t permitted to ask ‘do you take this person’ and have you reply ‘I do’ as a substitute for the legal words. That exchange is a lovely tradition and it can absolutely be included — it just sits alongside the legal wording rather than replacing it.

Use your full names, exactly as they appear on your Notice of Intended Marriage .

Your celebrant is also required to say a short statement called the monitum, which explains the legal nature of marriage in Australia. That one’s theirs to worry about, not yours.

How do the legal words and your own words fit together?

You say both. The usual order is the legal words first, then your personal vows immediately after — so the legal requirement is met, and then you get to say what you actually want to say.

On the day it runs like this: I introduce the vows, I feed you the legal words a line at a time and you repeat them, you read your personal vows from a card, then your partner does the same. Nothing to memorise.

There are four ways couples usually do this, and none of them is more correct than the others.

Legal words only

Short, dignified, done. A genuinely good choice, and always has been. Nobody in the audience will know or mind.

Legal words plus personal vows

You each write your own and read them aloud. The most common option by a distance.

Legal words plus promises you repeat after me

Personal content, but nothing to hold and nothing to memorise. Good if the reading-aloud part is what worries you.

Legal words plus vows you’ve written together

You write one set between you and both say it in turn. Lovely if you’d rather not write separately.

How long should wedding vows be?

About 150 words each, which is roughly one minute. Ninety seconds is plenty. Two minutes is the outer limit, and it will always feel longer out loud than it looks on the page.

This is the single most useful piece of advice I can give you, and the one couples resist most. Short vows aren’t less meaningful — they’re more. Every sentence that doesn’t earn its place dilutes the ones that do. If you have to cut, cut the general and keep the specific.

How do you actually start writing them?

Start by collecting rather than composing. Open a note in your phone and keep it open for a fortnight. Lines will arrive while you’re driving or falling asleep, and they’re almost always better than the ones you sit down and force.

When you’re ready to write, write badly and quickly. Get it all down — the too-much, the too-sentimental, the bits you’d never say out loud. You cut afterwards. Trying to write the final version straight out is what makes the blank page feel impossible.

Then apply three tests.

Is it specific?

‘You’re my best friend’ is true of most couples. ‘You are the person I want to tell things to first — the good news, the bad news, and the very boring news about the car’ is true of yours. Specific beats poetic every single time.

Does it sound like you?

If you don’t say ‘my beloved’ in real life, don’t say it at the altar. Vows written in a voice that isn’t yours sound performed, and everyone can hear it — including the person you’re marrying.

The best test I know: write it as though it’s a letter to them that nobody else will read, then take out only the things you’d genuinely be uncomfortable having your family hear. Usually that’s less than you’d think.

Can you actually keep the promise?

The good ones are the ones you can imagine keeping on an unremarkable Wednesday in eight years’ time.

Grand promises are fine and there should probably be one. But the promises that land are the ones with edges — to keep asking how their day was and actually listen to the answer, to always be the one who gets up in the cold.

What structure works for wedding vows?

If the blank page is the problem, borrow this skeleton and fill it in. No guest has ever noticed a structure.

Open with them — one or two sentences. Something specific about who they are, or a moment you shared.
Say what they’ve become to you — one or two sentences. What’s changed because of them.
Promise — three or four sentences. One large promise, two or three small and specific ones.
Close — one sentence. Short. One line that lands.

That’s about 150 words. That’s a minute. That’s a complete set of vows.

What should you leave out of your wedding vows?

Inside jokes that need explaining. If it takes a sentence of setup, it belongs in the speech, not the vows.
Anything at anyone else’s expense — an ex, a family member, a friend. It never lands the way you hope.
A list of everything you’ve ever done together. Choose one thing.
Promises you don’t mean. ‘I’ll never argue with you’ isn’t a vow, it’s a plan for an awkward anniversary.
A borrowed paragraph from a film, song or poem. One line as a garnish is lovely. A quoted passage isn’t yours.
Anything you can’t say without completely losing it. Keep one. Cut the rest.

What if you can’t get through them on the day?

You’ll probably cry. Most people do, and it’s fine — the room is entirely on your side.

A few things help. Slow down; nerves make everyone speed up, and speed is what makes voices break. Pause and breathe — a silence that feels endless to you is about two seconds to everyone else. Have a tissue on you, and don’t rely on your partner having one.

And if you truly can’t get through a line, hand the card to me. I’ll read it, and it will be just as moving.

Read them — don’t memorise them

Nobody expects you to recite. Memorising adds enormous pressure and gives you nothing, and if nerves take the words you’ve got nothing to fall back on.

Write them on a card or in a small book, in large type or clear handwriting. Hold it at chest height rather than up in front of your face — better for your voice, and better for the photos. Bring a spare copy and give it to me or someone in your wedding party; cards get left in cars and hotel rooms with alarming regularity.

Ask someone to record the audio

Couples tell me this constantly: the vows are the part you’ll most want to hear again, and the part most often missed because a microphone was pointed the wrong way.

Mention it to your photographer and whoever’s filming, in advance. It’s easily solved beforehand and impossible to fix afterwards.

Do you have to write vows at all?

No. Legal vows alone are completely valid, and a ceremony without personal vows can be every bit as moving as one with them. If the idea of speaking publicly fills you with dread, that’s a good enough reason on its own.

There’s no wrong answer here. There’s only the version that sounds like you.

Dylan + Jordan | A Scrubby Mountain Wedding

Beers down the aisle, a dog cartel + two Mums who got a major surprise.

Some weddings tell you exactly who the couple are before anyone has said a word.

Jordan and Dylan were married at "Jeulparry" on Valera Road, Scrubby Mountain, on a Saturday afternoon in March. A hundred and thirty people, fifty-two chairs, and a paddock with that particular hum you get when everyone in the crowd already knows each other.

The rehearsal had been the night before at The Mill Inn Tavern, which is also where everyone ended up a few hours later. Everything within cooee. Everyone already comfortable.

THE DETAILS THAT CAME FIRST

Before any of the fun, there was a quiet decision made weeks earlier. The front two rows were held for immediate family, and one seat was left empty for the people who couldn't be there. No announcement, no fuss - just a chair, set aside, understood by everyone who needed to understand it.

That's usually the tell. Couples who plan a wedding this relaxed have almost always thought hard about the things that matter.

Jordan's two brothers and young Jack came down the aisle handing beers out to the guests. Not a drink at the bar afterwards - beers, distributed mid-processional, to Right Said Fred.

Which meant the one request nobody expects to make at a wedding: if you've just been handed a fresh one and haven't cracked it yet, now's the moment. Let's avoid the "pssshhht" during the vows. To the crowd's enormous credit, it worked.

Then "Iris" started. The little ones came through, and the bridesmaids followed - Mim, Catie, Karli, and Kada as maid of honour. Everyone able to stand, stood.

By five to three the boys were in place — Dylan, with Brodie as best man, and his brothers Aidan, Lochlan and Aaron.

Then "I'm Too Sexy" started.

nine years in the making

Jordan and Dylan met properly at the Flinton Races in 2016, then spent the best part of three years long-distance while Dylan was in Charters Towers - Jordan taking a job seven hours away and driving up every second Friday, then moving closer, then closer again, until eventually there was a house and no more driving.

Dylan proposed on a cruise to Vanuatu in 2024. Jordan had spent the entire trip convinced he wasn't going to. She said yes before she'd fully registered the question, and had the ring on her own finger within seconds.

They arrived at Scrubby Mountain with two dogs, Carlos and Frankie - known in the family as the Mexican Drug Cartel - and a fairly clear idea of the kind of wedding they wanted. Nothing stiff. Nothing borrowed from anyone else's day.

Dylan told Jordan she'd always been his favourite person - that her care and organisation bring calm and structure to their lives, but it's her heart that holds everything together. He promised to be her partner, her safe place, and her biggest supporter.

Jordan told Dylan that with him, love feels like home. She promised to choose him even on the hard days, and to love him loudly when it matters and quietly when it counts most.

And then the line the whole afternoon hung off:

If I had to live this life a thousand times over, in every version of our story, I would still choose you.

two mums, one surprise

Jordan and Dylan had kept one thing back for the signing. Their witnesses were their mums - and neither mum knew until she was called forward.

"Forever and Ever, Amen" and "Buy Dirt" played through the paperwork, and the beer boys, still on duty, went back through the crowd handing out confetti.

Then "Accidentally In Love" started, and Mr and Mrs Ezzy came back down the aisle. They paused halfway for a kiss and got showered the whole way.

tHE KIND OF WEDDING THAT WAS

Not a single part of that afternoon was borrowed from a checklist. The beers, the song choices, the empty chair, the mums - every one of those decisions came from Jordan and Dylan, and the ceremony was built around them rather than the other way round.

That's the whole point. A ceremony should sound like the two people standing in it.

Your complete guide to the NOIM – Australia's most important wedding form.

If you're planning to get married in Australia, you'll need to complete a Notice of Intended Marriage – commonly called a NOIM (pronounced "noym"). It's one of the most important legal requirements, and you can't get married without it.

But what exactly is it? When do you need it? And what happens if you mess it up?

As a marriage celebrant in Toowoomba, I help couples navigate this process every day. Let me break it down for you in a way that actually makes sense.

WHAT IS A NOTICE OF INTENDED MARRIAGE (NOIM)?

The Notice of Intended Marriage is an official government form that declares your intention to get married. Think of it as your "application to get married."

It's a legal requirement under Australian law. Without a completed and properly lodged NOIM, you cannot legally marry in Australia.

Why Does It Exist?

The NOIM exists to:

Give the government notice of your intention to marry (hence the name!)
Ensure both parties are legally eligible to marry
Allow time for any legal impediments to be identified (like if one person is already married)
Provide a cooling-off period to ensure both parties are certain

The one-month waiting period is designed to prevent impulsive marriages and give people time to reconsider if needed.

When Do You Need to Lodge Your NOIM?

The Rule:

Your NOIM must be lodged at least one month and one day before your wedding date.

Let's break that down:

If your wedding is on May 20th, your NOIM must be lodged by April 19th at the latest
If your wedding is on December 1st, your NOIM must be lodged by October 31st at the latest

When Should You Actually Lodge It?

While the legal minimum is one month, I recommend lodging your NOIM 2-6 months before your wedding. Here's why:

✓ Less stress – You're not cutting it close to the deadline
✓ Time to fix errors – If there's a mistake, you have time to correct it
✓ Document issues – If you need to order documents (like an overseas birth certificate), you have buffer time
✓ Peace of mind – One less thing to worry about as your wedding approaches

How Long Is It Valid?

Once lodged, your NOIM is valid for 18 months.

This means:

You can lodge it well in advance without it expiring
If you need to postpone your wedding (within 18 months), your NOIM is still valid
If you don't marry within 18 months, you'll need to complete a new NOIM

Where Do You Lodge Your NOIM?

You lodge your NOIM with your celebrant – not with the government directly.

How It Works:

You book your celebrant (hopefully me!)
We arrange a meeting (in person, video call, or in some cases remotely)
We complete the NOIM together – I'll guide you through every question
You sign it in my presence (or in some cases, in front of another authoriSed person)
I lodge it and keep it on file
Done! You'll receive a copy for your records

Can You Lodge It Yourself?

No. The NOIM must be completed and witnessed by an authoriSed person, which includes:

Your marriage celebrant
A Justice of the Peace
A Commissioner for Declarations
A lawyer
Other authorised officials

Most couples complete it with their celebrant because it's convenient and we can answer questions on the spot.

What Information Is on the NOIM?

The NOIM asks for information about both parties. Here's what you'll need to provide:

Personal Details:

Full legal names (as they appear on your birth certificate)
Any other names you've been known by
Dates of birth
Places of birth
Current residential addresses
Occupations
Relationship to each other (if any – e.g., if you're related by blood)

Parents' Details:

Full names of both your parents
Their dates and places of birth (if known)

Marriage History:

Whether you've been married before
If yes, how that marriage ended (divorce, death, annulment)
Details of previous marriages

Your Ceremony:

Your intended wedding date
Location of ceremony
Details of your celebrant

Under 18?

If either party is under 18, additional information is required (parental consent, court approval)

What Documents Do You Need to Bring?

When you meet with your celebrant to complete your NOIM, you must provide:

Evidence of Date and Place of Birth:

One of the following:

Birth certificate (full, not commemorative)
Passport (current or expired)
Citizenship certificate (if born overseas)

Photo ID:

One of the following:
Driver's licence
Passport
Proof of Age card

If Previously Married:

Divorce papers (Decree Absolute/Divorce Order)
OR Death certificate of former spouse

If Born Overseas:

Birth certificate from country of birth
NAATI-certified translation (if not in English)

Pro tip: Make copies of everything. Your celebrant will need to see the originals and may keep copies for their records.

The NOIM Process Step-by-Step

Here's exactly what happens:

Step 1: Book Your Celebrant

Choose your celebrant and confirm your wedding date. This should be one of your first bookings!

Step 2: Gather Your Documents

Collect all required documents (birth certificate, ID, divorce papers if applicable, etc.)

Step 3: Schedule Your NOIM Meeting

Your celebrant will arrange a time to complete the NOIM with you. This can be:

In person (most common)
Via video call (in some circumstances)
With documents verified remotely (less common)

Step 4: Complete the NOIM

At your meeting:

Your celebrant will go through the form with you
They'll explain each question
You'll provide your information
You'll both sign it in their presence
Your celebrant will verify your documents
This usually takes 30-45 minutes.

Step 5: Your Celebrant Lodges It

Your celebrant will:

Keep the original NOIM on file
Give you a copy for your records
Note the date it was lodged

Step 6: Wait One Month

The one-month waiting period begins from the date your NOIM is lodged, not the date of your meeting.

Step 7: Get Married!

Once the one-month period has passed, you can legally marry anytime within the next 18 months.

What Happens If You Miss the One-Month Deadline?

If your wedding is less than one month away and you haven't lodged your NOIM, you cannot legally get married on your planned date.

Your Options:

Option 1: Postpone Your Wedding The simplest solution is to move your wedding date to at least one month after you lodge your NOIM.

Option 2: Apply for a Shortening of Time In exceptional circumstances, you can apply to have the one-month notice period shortened. However, this is:

Rarely granted
Requires special permission from a prescribed authority (like a judge or registrar)
Only for exceptional circumstances such as:
Serious illness or medical emergency
Imminent overseas deployment (military)
Other compassionate grounds

Important: "We forgot" or "we've already booked the venue" are NOT considered exceptional circumstances. Don't rely on this option!

Option 3: Have a Commitment Ceremony If you can't legally marry on your planned date, you could:

Have a commitment ceremony (like a wedding, but not legally binding)
Then do the legal paperwork and a small ceremony later

The Lesson:

Don't leave your NOIM to the last minute! Lodge it 2-6 months before your wedding to avoid stress.

Common NOIM Mistakes (And How to Avoid Them)

❌ Mistake #1: Leaving It Too Late

Solution: Lodge your NOIM at least 2 months before your wedding, not 1 month.

❌ Mistake #2: Spelling Errors

Your name must match your birth certificate exactly. "Katherine" vs "Catherine" matters!
Solution: Double-check spelling before signing.

❌ Mistake #3: Missing Documents

Showing up without your birth certificate or ID means you can't complete the NOIM.
Solution: Confirm with your celebrant what you need to bring.

❌ Mistake #4: Using a Commemorative Birth Certificate

The decorative birth certificate you got as a baby won't work – you need the official one.
Solution: Order your full birth certificate from Births, Deaths and Marriages if needed.

❌ Mistake #5: No Translation

If your birth certificate isn't in English, you need a NAATI-certified translation.
Solution: Arrange translation early – it can take weeks.

❌ Mistake #6: Incomplete Divorce Documents

If you're divorced, your celebrant needs proof. "It's in process" doesn't count.
Solution: Ensure your divorce is finalised before your wedding date.

❌ Mistake #7: Not Knowing Parents' Details

The NOIM asks for your parents' full names and dates/places of birth.
Solution: Ask your parents before your meeting!

What If You Need to Change Details After Lodging?

If something changes after you've lodged your NOIM (like your address or wedding date), you need to tell your celebrant.

Minor changes (like address) can usually be noted on the form.

Major changes (like changing who you're marrying – hopefully not!) require a new NOIM.

If you postpone your wedding but it's still within 18 months, your existing NOIM is still valid. Just confirm the new date with your celebrant.

NOIM and Your Privacy

Your NOIM contains personal information. Here's what happens to it:

✓ Your celebrant keeps it securely on file for 7 years (legal requirement)
✓ It's not published anywhere
✓ It's not given to the government until after your wedding
✓ Your private information stays private

After your wedding, your celebrant will lodge your marriage certificate with Births, Deaths and Marriages, but your NOIM itself stays with them.

Everything you need to know about getting married quickly in Queensland.

So you need to get married – fast.

Maybe you've just found out about a job opportunity overseas. Maybe there's a visa deadline. Maybe someone is seriously ill and you want them at your wedding. Or maybe you just realised that your "plenty of time" to plan has somehow evaporated and your wedding is three weeks away.

Whatever the reason, you're wondering: Can we actually get married in less than a month in Australia?

The short answer is: Usually no, but sometimes yes.

As a marriage celebrant in Toowoomba, I've helped couples navigate rush weddings, last-minute changes, and tight timelines. Let me explain what's possible, what's not, and how to make it work if you're in a time crunch.

the one-month rule

First, let's be clear about the legal requirement:

In Australia, you must lodge your Notice of Intended Marriage (NOIM) at least one month and one day before your wedding date.

This is not a suggestion. It's the law.

For example:

Wedding on March 15th = NOIM must be lodged by February 14th
Wedding on June 1st = NOIM must be lodged by May 1st

This means if you haven't lodged your NOIM yet and your wedding is in less than a month, you legally cannot get married on that date.

BUT WAIT - CAN THE ONE-MONTH PERIOD BE SHORTENED?

Yes - but only under very specific circumstances.

Under Australian marriage law, a "prescribed authority" (like a judge, magistrate, or registrar) can authorise a shorter notice period if there are exceptional circumstances.

What Counts as "Exceptional Circumstances"?

The law doesn't define this precisely, but it generally includes:

✓ Serious illness or medical emergency
For example, if someone close to you (or one of you) is terminally ill and you want them to be at your wedding.

✓ Imminent overseas deployment
Military personnel being deployed at short notice.

✓ Employment or visa requirements

What Does NOT Count?

❌"We've already booked the venue and can't change the date"
❌"Our families are flying in and we can't reschedule"
❌"We just really want to get married sooner"
❌"It would be expensive to change everything"

The bottom line: Just wanting to get married quickly is not enough. There needs to be a genuine, exceptional reason.

HOW TO APPLY FOR A SHORTENING OF TIME

If you believe you have exceptional circumstances, here's the process:

Step 1: Contact Your Celebrant Immediately

Tell them your situation and why you need a shortened notice period. They'll advise whether your circumstances might qualify.

Step 2: Lodge Your NOIM

You still need to complete and lodge your NOIM, even though you're applying to shorten the period.

Step 3: Apply for Permission

You (or your celebrant on your behalf) will need to apply to a prescribed authority for permission to shorten the notice period.

Who are prescribed authorities?

Judge or magistrate
Registrar of Births, Deaths and Marriages
Minister of religion of a registered denomination
Marriage celebrant (in some cases)
Your celebrant will usually guide you to the appropriate authority.

Step 4: Provide Evidence

You'll need to provide evidence of your exceptional circumstances. This might include:

Medical certificates or letters from doctors
Employment letters or deployment orders
Visa documentation
Statutory declarations
Other supporting evidence

Step 5: Wait for Approval

The prescribed authority will review your application and decide whether to grant permission.

Important: There's no guarantee your application will be approved. Even with genuine reasons, it's at the discretion of the authority.

Step 6: Get Married (If Approved)

If permission is granted, you can marry before the one-month period is up. Your celebrant will need a copy of the approval to proceed legally.

HOW LONG DOES THE PROCESS TAKE?

This varies depending on:

Which authority you apply to
How quickly you can provide evidence
The authority's workload
The strength of your case

Realistically, you should allow at least 1-2 weeks for this process , which means if your wedding is in less than 2 weeks and you haven't started the application, it may not be possible.

WHAT IF I CAN'T GET PERMISSION ?

If you can't get permission to shorten the notice period, you have a couple of options:

The simpliest option is to move your wedding to at least one month after you lodge your NOIM
Have a commitment ceremony now, legal ceremony later (this is becoming increasingly popular)

Everything you need to know about getting legally married in QLD – without the confusing jargon

Planning a wedding is exciting, but navigating the legal requirements? That can feel overwhelming. The good news is that getting legally married in Queensland is actually pretty straightforward once you understand what's required.

As a marriage celebrant based in Toowoomba, I guide couples through this process every day. So let me break it down for you in plain English – no legal jargon, no confusion, just the facts you need to know.

The Three Essential Legal Requirements

To get legally married in Queensland (or anywhere in Australia), you need three things:

Complete a Notice of Intended Marriage (NOIM ) at least one month before your wedding
Provide the required documents to prove your identity and eligibility
Have your ceremony conducted by an authorised celebrant (that's where I come in!)

LET'S BREAK EACH OF THESE DOWN.

1. Notice of Intended Marriage (NOIM)

What is it?

The Notice of Intended Marriage is an official form that tells the Australian government you intend to get married. It's a legal requirement – you can't get married without it.

When do you need to lodge it?

At least one month and one day before your wedding date.

For example:

If your wedding is on April 15th, you must lodge your NOIM by March 14th at the latest
Most couples lodge it 2-6 months before their wedding to avoid last-minute stress

Can this deadline be shortened?

In some exceptional circumstances (like a serious illness or an overseas deployment), the one-month notice period can be shortened. However, this requires special permission from a prescribed authority and is rarely granted.

Where do you lodge it?

You lodge your NOIM with your celebrant – that's me! We'll complete it together during one of our meetings. It can be done in person, or remotely if needed.

What information do you need?

The NOIM asks for:

Your full legal names
Dates and places of birth
Current addresses
Occupations
Details of any previous marriages (and how they ended)
Your parents' names
Whether either of you are under 18 (requires parental consent and court approval)
Whether you're related by blood or adoption

How long is it valid?

Your NOIM is valid for 18 months from the date it's lodged. If you don't get married within that time, you'll need to complete a new one.

2. Required Documents

When you lodge your NOIM, you need to bring certain documents to prove your identity and eligibility to marry.

Everyone Needs:

✓ Proof of Date and Place of Birth

You must provide one of the following:

Birth certificate (full birth certificate, not the commemorative one)
Passport (current or expired is fine, as long as it's yours)
Citizenship certificate (if born overseas and later became an Australian citizen)
Important: If your birth certificate is in a language other than English, you must provide a NAATI-certified translation.

✓ Photo ID

You must provide one of the following:

Driver's licence
Passport
Proof of Age card

If You've Been Married Before:

If either of you has been married previously, you must prove that marriage has legally ended:

Divorce: Provide your Decree Absolute or Divorce Order
Death of spouse: Provide the death certificate

Important: If your divorce was finalised overseas, you may need additional documentation. Check with your celebrant.

If You Were Born Overseas:

If you were born outside Australia, you need:

Your birth certificate (or legal equivalent) from your country of birth
If it's not in English, a NAATI-certified translation

Tip: Some countries can take months to issue birth certificates. If you were born overseas, start this process early! Alternatively, a passport is often easier and perfectly acceptable.

If You're Under 18:

Marriage under 18 is only permitted in exceptional circumstances and requires:

Parental consent
Court approval

This is rare and involves a complex legal process. Speak to your celebrant if this applies to you.

3. The Ceremony Requirements

For your marriage to be legal in Australia, your ceremony must meet these requirements:

✓ Authorised Celebrant
Your ceremony must be conducted by a registered marriage celebrant (like me!) or a religious minister. You can't have a friend "marry you" unless they're actually registered.

✓ Two Witnesses
You need at least two witnesses who are 18 or over. They'll sign your marriage certificate along with you and your celebrant.

✓ Prescribed Words (The Legal Bit)
During your ceremony, you both must say the following legal words:

"I call upon the persons here present to witness that I, [your name], take thee, [partner's name], to be my lawful wedded [wife/husband/spouse]."

These words (or a similar approved variation) are required by law. Everything else in your ceremony can be completely personalised!

✓ Exchanging Vows
You'll exchange vows or promises to each other. These can be traditional, personalized, or anything in between – the choice is yours.

✓ Signing the Certificates
After the ceremony, you, your partner, your two witnesses, and your celebrant will sign:

Your official marriage certificates (there are usually 3 copies)
The celebrant's registry

The Timeline: When to Do What

Here's a simple timeline to keep you on track:

6-12 Months Before Your Wedding:

✓ Book your celebrant
✓ Start gathering required documents (especially if you were born overseas)

2-6 Months Before:

✓ Meet with your celebrant to complete your NOIM
✓ Provide all required documents

At Least 1 Month Before:

✓ NOIM must be lodged (this is the legal deadline!)

2-4 Weeks Before:

✓ Final ceremony review with your celebrant
✓ Confirm your two witnesses

Your Wedding Day:

✓ Sign your DCLI (Declaraition of No Legal Impediment)

✓ Get married!
✓ Sign the official paperwork

After Your Wedding:

✓ Your celebrant lodges your marriage certificate with Births, Deaths and Marriages
✓ You'll receive your official marriage certificate in the mail (usually 4-6 weeks later)

EVERYONE NEEDS:

Birth certificate OR passport

What Happens If You Don't Meet the Requirements?

If you haven't lodged your NOIM at least one month before your wedding, you cannot legally get married on that date . You'll need to postpone.

If you don't have the correct documents, your celebrant cannot legally marry you. This is why I always recommend getting your paperwork sorted early!
